These terms govern your use of bragdev.com and the BragDev Talent service, offered by BragDev LLC (“BragDev”, “we”, “us”), 7410 Sherwood Rd, Austin, TX 78745. By using the site, creating an account or paying for a membership, you agree to them. If you use BragDev on behalf of a company, you confirm you can bind that company.
1. Using the site
- You must be at least 18.
- Give accurate information and keep it up to date.
- Keep your password private. You are responsible for what happens under your account; tell us at contact@bragdev.com if you think someone else used it.
- Don’t misuse the site: no attempts to break in, scrape it, overload it, send spam through its forms, or impersonate someone.
2. For companies: the 90-Day Talent Access Membership
2.1 How it starts
- The first calibration conversation is free.
- If BragDev is a good fit for the role, we send a written membership proposal with the role, the price and anything specific to your search. The proposal and these terms together make up our agreement; if they conflict, the proposal wins.
- Your 90 days start on the day of your intake call, so no paid time is used before your search begins. We schedule the call with you after we receive your payment. If it has not happened within 30 days of payment, your term starts on that 30th day.
- If you renew while you still have paid time, the new term starts when the current one ends.
- We may add days to a term at our discretion, for example if we reschedule your intake call. Your client portal always shows your current dates.
2.2 What we provide during the term
- A written role scorecard you approve before sourcing starts.
- Targeted sourcing against that scorecard.
- Vetting of every professional before we present them.
- A written progress update every week.
- An evidence profile for every professional we present, showing which claims we verified and which are self-reported.
- Coordination of the interviews you choose to hold.
- Access to the client portal from the day you pay. After the term ends, the portal stays available read-only.
2.3 What we don’t guarantee
The membership pays for a disciplined search, not a result. We don’t guarantee a hire, a match or an engagement within the 90 days, a set number of candidates, or that a professional accepts your offer. If we can’t find someone who meets the scorecard, we tell you and share what we learned.
2.4 Your part
- Describe the role accurately and tell us if the role, budget or approval changes.
- Give feedback on the professionals we present within a reasonable time.
- Make your own hiring decisions, follow employment and anti-discrimination laws, and complete any checks your own policies require (for example, work authorization).
2.5 Fees and payment
- The price is in your proposal. You pay through our checkout, run by SureCart; card payments are processed by Stripe. We never see or store your card number.
- Prices don’t include taxes unless the proposal says so.
- Refunds follow our Cancellation & Refund Policy. In short: no refunds for unused time once a term has started.
2.6 Candidate information is confidential
Evidence profiles, names and anything else we share about professionals are confidential. Use them only to evaluate people for the role in your membership. Don’t share them outside the people at your company who need them for that decision, and don’t contact a professional we presented except through BragDev until we have introduced you.
2.7 When you hire a professional we introduced: conversion fee
Every engagement is direct: your company hires or engages the professional and pays them. If, within 12 months after we present or introduce a professional to you, your company (or anyone acting for it) hires or engages that professional in any role, you agree to pay BragDev a one-time conversion fee of 20% of the professional’s first-year compensation. First-year compensation means the annual base salary for an employee, or the total fees payable for the first 12 months of work for a contractor. The fee is due within 30 days after the professional starts. Tell us when the hire happens.
2.8 The engagement itself
The terms of any engagement (scope, schedule, start date and how it is contracted) are agreed in writing between the parties before any work begins. BragDev is a party to that engagement only if that written agreement says so.
3. For professionals
- Applying is free and does not guarantee acceptance, a vetting outcome or paid work.
- The network currently accepts professionals based in the United States.
- Vetting decisions are BragDev’s, based on the evidence in your file. You agree that we may verify the identity, history and references you give us.
- Everything you tell us must be true. Skills you declare stay marked “self-reported” until we verify them.
- We ask you before we present you for a role, and before we share your name or contact details with a client. Clients never see your desired rate.
- You can update your profile in the talent portal, or ask us to remove you from consideration, at any time.
- The terms of any engagement are agreed in writing before any work begins.
4. For technical interviewers
Candidate information you see is confidential and may be used only to evaluate that candidate. Your evaluations are your own professional judgment. Once submitted, an evaluation can’t be edited; you can amend it as a new version with a reason.
5. Content and intellectual property
The site, its text, design and logo belong to BragDev. You keep ownership of what you give us (profiles, role descriptions, feedback) and allow us to use it to run the service as described in our Privacy Policy.
6. Disclaimers
Except for what these terms and your proposal promise, the site and service are provided “as is”. We work carefully, but we don’t promise the service will be uninterrupted or error-free, or that any professional will perform in a particular way after an engagement starts.
7. Limit of liability
To the extent the law allows, BragDev is not liable for indirect, incidental, special or consequential damages, or lost profits. Our total liability for any claim about the service is limited to the fees you paid BragDev in the 12 months before the claim. Some laws don’t allow these limits, so they may not apply to you in full.
8. Ending your use
You can stop using the service at any time and ask us to close your account. We may suspend or close an account that breaks these terms, after telling you why when it’s reasonable to do so. Sections 2.6, 2.7, 5, 6, 7 and 9 continue after an account or membership ends.
9. Law and disputes
Texas law governs these terms, without regard to its conflict-of-law rules. Disputes go to the state or federal courts in Travis County, Texas. Before going to court, please contact us so we can try to solve the problem.
10. Changes to these terms
We may update these terms. We’ll change the “Last updated” date, and for significant changes we’ll tell members and professionals by email before they take effect. A membership already paid for keeps the terms in force when it started.
